CAVANAGH SORICH LAW GROUP FILES NEGLIGENCE SUIT IN 8-CAR CRASH ON OHIO FEEDER RAMP

CHICAGO — Cavanagh Sorich Law Group has filed a negligence suit after an eight-car crash on the Ohio Feeder Ramp sent five people, including a child, to hospitals on Nov. 26.

The lawsuit alleges an Allen Brothers food delivery truck slammed into an Uber vehicle while exiting I-90 on the afternoon of Nov. 26 — causing several cars to crash into one another. The drivers of both the Allen Brothers truck and the Uber failed to take into account snowy and wet road conditions.

“Drivers have to be aware of the weather conditions and make appropriate adjustments when driving,” attorney Timothy Cavanagh said. “That was not done in this case, and the recklessness of the truck driver and Uber driver caused this serious crash.”

The lawsuit was filed in the Circuit Court of Cook County on behalf of Ronald Young and the Brady family: husband John, wife Sarah and their 11-year-old daughter. All four are residents of Chicago.

It names as defendants Uber; Allen Brothers; Chicago Truck Leasing Co., which owns the Allen Brothers delivery truck; The Chefs’ Warehouse; and Kurt Bihlmayer, who drove the Allen Brothers truck.

Illinois State Police traffic reports list the Allen Brothers truck as the vehicle that set off the chain-reaction crash about 2:10 p.m. Nov. 26.

Sarah Brady and her 11-year-old daughter were passengers in the Uber. Ronald Young was driving a separate vehicle he had rented for the purpose of driving for Uber. All three were rushed to hospitals after the crash. The Brady family and Young are now responsible for hefty medical and hospital bills.

According to the suit, each of the defendants was negligent in one or more of the following respects:

  1. Failing to maintain proper control over his/her vehicle to avoid colliding with another vehicle;
  2. Failing to reduce speed to avoid colliding with other vehicle(s) on the roadway in violation of 625 ILCS 5/11-601(a);
  3. Proceeding at a speed which was greater than reasonable and proper with regard to traffic conditions and the use of the highway, or which endangered the safety of persona or property in violation of 625 ILCS 5/11-601(a); and
  4. Failing to keep and maintain a proper lookout.

The Hon. Judge Allen P. Walker of the Cook County Circuit Court will preside in the case of Brady and Young v. AB Steaks, Inc., The Chef’s Warehouse Midwest, LLC, Chicago Truck Leasing Co., Kurt Bihlmayer, and Uber Technologies, Inc., Case No.: 2018 L 012759.
